TERMS OF SERVICE

Before starting a project, we need to make sure we are on the same page so there aren't misunderstandings and to protect against fraud, so please take some time to read through these terms! Thank you.This Terms of Service agreement is between I, the artist, and you, the client for the commission of an artwork known as the work.CONTENT
⟡ I have the right to refuse projects and requests that I am uncomfortable making, be it due to my capacity or judgment. This may include, but not limited to, the following:
- Complex backgrounds
- Explicit NSFW
- Furries
- Heavy gore
- Mecha
- Political artworks
- Cultures I may not be able to represent properly⟡ I will ensure that the work I will produce is 100% original and is made to the best of my abilities. In line with this, I am still improving and developing my artistic style thus will be subjected to minor changes.⟡ I guarantee that, aside from existing character designs, I will not copy or heavily reference unauthorized materials as I produce the work. furthermore, I have the right to utilize copyright-free, commercially licensed assets and tools.TIMELINE AND PROCESS
⟡ Depending on the commission type, complexity, and workload of the project, work completion would take a minimum of 3 weeks and may take up to 6 weeks to 6 months. Subsequently, deadlines and timelines will be followed to the best of my abilities.⟡ If there are any delays or adjustments to the timeline, I will inform the client so that amendments can be made and agreed upon. The client has the right to request for refunds if the work has not been delivered within 6 months and no amendments to the timeline was made.⟡ I will regularly update the client regarding the commission and would ask for your feedback voluntarily.⟡ Three major revisions is allowed per item shown to you during the process. After lineart phase, only minor revisions can be done. For excessive revisions, additional charges may be required since it may affect the progress and timeline of the work.COMMUNICATION
⟡ Ongoing communication will be done throughout the project timeline with updates and idea generation and collaboration. Furthermore, I will ask for feedback when I have something to show and I will also update you if delays or priority shifts occurs in the project.⟡ I will contact you through the socials you have inputted in the Google form to aid in communications. I would usually respond quickly but may also take up to at least a few days in order to provide more concrete updates.RIGHTS, USAGE & CREDITArtist Rights
⟡ I retain original copyright and ownership of the work, which includes but may not be limited to redistributing, advertising, reproducing, and displaying the work and work in progress in my websites, social media, and portfolios according to my discretion. Moreover, I have rights to repurpose unused process work for future projects personal or otherwise.⟡The process will most likely be posted on twitter and/or streamed on Twitch or Youtube unless client requests otherwise before project begins. A NDA or confidential commission status may be subject to a 10% fee.Client Rights
⟡ Clients are given exclusive, non-transferrable rights to the work, as agreed upon, for personal use.⟡ Personal use includes: social media profile pictures, banners, layout themes, wallpapers, personal website display, and social media posts that are not for sale or distribution to other parties.⟡ Clients may not claim the Work as their own or anyone else's and therefore must credit me as the artist using my social tag @haruruumaruu.⟡ Client must not edit or modify the work in any way without prior permission from the artist.⟡ Usage of the work for AI (artificial intelligence) and ML (machine learning) tools, platforms, or programs; NFT, blockchain, or other for profit platform or purposes is strictly prohibited.PAYMENT, CANCELLATION, & REFUNDSPayment
⟡ Before starting the project, client must pay at least 50% intial payment, with the remaining 50% before delivery of work.⟡ Prices are in USD/PHP and paid through Paypal, Ko-fi, or Gcash. Prices may vary depending on type, complexity, requirements, and/or additional requests.Paypal
I will send an invoice to your email once work is ready to begin.Gcash
I will send you a QR code of my account once work is ready to begin.⟡ Do not send a payment without my request. After consultation, I will send payment links within a reasonable amount of time.⟡ Payment is expected within 72 hours, unless communicated otherwise in advance, when the payment receipt is sent or the project/waitlist position is cancelled by the artist.⟡ Once payment has been dealt with and work has begun on the project, the client acknowledges that the deliverables are DIGITAL and there are no physically shipped goods to receive. Chargebacks are not permitted and the refund policy as mentioned will be followed.CANCELLATION & REFUND
⟡ If client requests cancellation, 50% of project fees may be forfeited if cancelled in less than 2 days before work starts.⟡ If any unexpected reason I cannot complete the work or it is significantly delayed by 4 months, I will take the initiative to inform you and provide a partial refund if work done up to this point is accepted or full refund.AGREEMENT

⟡ Base prices includes plain or solid/gradient background only (unless specifiedotherwise)
⟡ Detailed backgrounds +25% of base price
⟡ Detailed characters +$10 of base price
⟡ Additional character/s are the same with the base price for one character.
⟡ Finished works will be delivered through Google Drive.
⟡ Please make sure to read through the Terms of service as well!

PAYMENT

⟡ Payments are made through Paypal (usd), Ko-fi (usd), or gcash (php)
⟡ Full payment or 50% initial down payment before commission is started.
⟡ Refunds are not possible after sketch phase is completed.

⟡ After settling the details of the commission, please pay the agreed upon amount (either full payment or 50% of payment) before I start sending the preliminary sketches and color planning.
⟡ Revisions can be done during the sketch phase. Minor revisions can be done in the inking and flats phase
⟡ Additional charge is required for any further revisions that may impact the progress and impact of the project.
